Terms of Service

By downloading, installing, or using the PostureCoach app ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. The App

PostureCoach uses motion sensors in compatible AirPods (Pro, Max, 3rd-generation) to detect when you are slouching and sends gentle reminders to help improve your posture. The App is provided on an "as is" basis. We do not guarantee any health or medical outcome and the App is not a substitute for professional medical advice.

2. Subscription and Purchases

PostureCoach is offered as a subscription service and as a one-time purchase, sold through Apple's App Store.

• Yearly Subscription ($19.99/year): Includes a 7-day free trial for new subscribers. After the trial, the subscription auto-renews yearly unless cancelled at least 24 hours before the end of the current period.
• Lifetime Access ($49.99 one-time): A single payment grants permanent access to all current and future Subscription features.

Payment is charged to your Apple ID account at confirmation of purchase. You can manage and cancel subscriptions through your Apple ID account settings.

3. Refunds

All payments are processed by Apple. Refund requests must be made through Apple's Report a Problem page. We have no control over Apple's refund policy.

4. Auto-Renewal Disclosure

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription by going to your account settings on the App Store after purchase.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or modify the App.
• Use the App for any unlawful purpose.
• Attempt to circumvent the paywall or other security features.
• Resell, sublicense, or redistribute the App or its data.

6. Health Disclaimer

PostureCoach is a wellness app, not a medical device. The App does not diagnose, treat, cure, or prevent any disease or condition. If you have chronic pain, an injury, or any concerns about your posture or musculoskeletal health, please consult a qualified healthcare professional. Discontinue use immediately if you experience pain or discomfort.

7. Intellectual Property

All content in the App, including code, design, text, and graphics, is owned by us and protected by international copyright laws. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal Apple devices.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via our website. Your continued use of the App after changes constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms. You may stop using the App at any time by uninstalling it.

12. Governing Law

These Terms are governed by the laws of Tunisia, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Tunisia.
